These Terms govern your use of DELF Prep. By creating an account, purchasing a plan, or using the platform, you agree to these Terms, our Privacy Policy, our Refund Policy, and our Cookie Policy.

Acceptance of these Terms

These Terms of Service ("Terms") govern your access to and use of DELF Prep, available at delfprep.com, and any related services, content, and features (together, the "Service"). Throughout these Terms, "we", "us", and "our" refer to DELFPrep Inc., the operator of the Service, based in Ontario, Canada. "You" means the person who creates an account, makes a purchase, or otherwise uses the Service.

You accept these Terms by creating an account, purchasing a plan, or using the Service. We record the version of these Terms in effect at the time of your acceptance. The version of these Terms in effect at the time of a specific purchase governs that purchase. If you do not agree to these Terms, do not use the Service.

Independence & no affiliation

DELF Prep is an independent study tool for candidates preparing for the DELF examination. We are not affiliated with, endorsed by, certified by, or acting on behalf of France Éducation international, the French Ministry of Education, any test centre, or any official DELF examination body.

"DELF" and related names are trademarks of their respective owners and are used here for descriptive purposes only. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Eligibility & accounts

You must be at least fourteen (14) years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

Some features require an account. You agree to provide accurate registration information, keep it current, and keep your login credentials confidential. You may not create more than one account for yourself, transfer your account to anyone else, or allow another person to use your account. You are responsible for activity under your account until you notify us in writing of any unauthorized use. We may suspend or restrict an account we reasonably believe is compromised, misleading, abusive, or used in violation of these Terms.

What the Service includes

The Service currently includes, among other things:

  • A free demo with a short mock exam and full AI scoring on writing and speaking, with no account or payment required.
  • Full timed mock exams for DELF A1, A2, B1, and B2, run in official section order with realistic timing.
  • A bilingual study guide of written lessons and self-check quizzes for each level, with the first lesson of each unit free and the rest unlocked with a paid plan.
  • Practice exercises and graded attempts unlocked with a paid plan.
  • Automated AI feedback on writing and speaking, scored against the published DELF rubric criteria.
  • Account-based progress tracking, score history, dashboards, settings, and email-preference controls.

Features, limits, pricing, content coverage, plan packaging, and AI-provider selection may change over time. We do not guarantee that every feature will remain available indefinitely or remain exactly as currently configured.

Pricing, payment & plans

Paid access is offered both as recurring subscriptions (for example, Monthly and Quarterly plans) and as one-time purchases (for example, a time-limited Pass or Lifetime access). What you are buying, and whether it renews, is shown clearly at checkout before you pay.

Prices are listed in US dollars by default and may be displayed in euros or Canadian dollars based on your location. Applicable taxes are added at checkout based on your billing address. Payments are processed by Stripe; we do not store your full payment-card details on our servers.

Subscriptions renew automatically at the then-current price until you cancel. You can cancel at any time from your account settings; cancellation stops future renewals, and you keep access until the end of the current billing period. Time-limited purchases expire automatically at the end of the purchased period and revert to the free tier; no refund or extension is owed for unused time after expiry.

We may refuse, cancel, or reverse access where required for fraud prevention, payment-failure handling, sanctions or export-control compliance, or abuse investigation.

Fair use

Paid plans include unlimited DELF mock exams and AI feedback on your written and spoken work for the duration of your plan. To keep the Service available to everyone and to prevent automated abuse, we apply a reasonable per-day limit on AI grading and mock-exam starts. These limits are generous, and a typical learner preparing for an exam will not reach them. If you reach a daily limit, it resets the next day. We may adjust these fair-use limits over time; any change applies going forward.

Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms. By purchasing a plan, you accept the version of the Refund Policy in effect at the time of your purchase. Subject to your statutory rights, the refund process described in that policy is your sole and exclusive remedy for any dissatisfaction with the educational outcomes, AI-feedback quality, score estimates, or perceived value of the Service.

AI outputs & study guidance

Some features use automated AI systems to generate questions, scores, level estimates, and feedback. These outputs are study aids only. They are not official marking, certified language assessment, predictions of how you will perform on an actual DELF exam, or guarantees of any educational, immigration, or employment outcome.

AI outputs can be incomplete, inaccurate, inconsistent, or unavailable. You remain responsible for reviewing any feedback before relying on it. Do not submit sensitive personal information, government identifiers, payment-card numbers, or third-party confidential information in writing or speaking sessions.

Your continued use of these features constitutes acceptance of these limitations.

Your content

You retain ownership of the content you submit, including writing responses, spoken responses and their transcripts, contact-form messages, and profile information (collectively, "Your Content"). You grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, reproduce, transmit, process, analyze, adapt, and display Your Content to operate the Service, and a perpetual right to use de-identified and aggregated forms of Your Content to operate, secure, evaluate, and improve the Service.

You represent that you have the rights necessary to submit Your Content and that it does not infringe third-party rights or violate applicable law. You are solely responsible for Your Content.

Acceptable use

You agree not to:

  • Use the Service in a way that violates any applicable law or regulation.
  • Share your account, resell access, create multiple accounts, or help others bypass plan gates, free-tier limits, rate limits, or security controls.
  • Copy, scrape, systematically extract, redistribute, mirror, or publicly post our questions, audio, sample answers, AI feedback, or other content without our express written permission.
  • Interfere with the platform, probe for vulnerabilities, introduce malware, or attempt unauthorized access to other users, systems, or data.
  • Use bots, headless browsers, scripted clients, or other automated tools to access the Service in bulk, except where we expressly allow it.
  • Submit unlawful, infringing, abusive, deceptive, or harmful content through the writing tools, speaking practice, contact forms, or any other feature.
  • Use our AI feedback or model outputs to develop, train, or evaluate any product that competes with us.

Intellectual property & liquidated damages

The Service, including its software, design, branding, questions, audio, sample answers, AI feedback, score reports, and underlying datasets, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Service solely for your personal, non-commercial study in accordance with these Terms. No other rights are granted by implication, estoppel, or otherwise.

You acknowledge that unauthorized copying, scraping, redistribution, or public posting of our questions, audio, sample answers, or AI feedback would cause us harm that is difficult to quantify. As a genuine pre-estimate of damages, and not as a penalty, you agree to pay us liquidated damages of CAD $5,000 per question, audio file, or feedback record copied, scraped, redistributed, or posted in violation of these Terms, in addition to any other remedy available to us at law or in equity, including injunctive relief.

Third-party services

We rely on third-party service providers to operate parts of the Service, including:

  • Stripe Payments Canada Ltd.: checkout, payment processing, tax calculation, refunds, and fraud screening.
  • Anthropic, PBC (Claude): AI writing-feedback grading.
  • Google LLC (Gemini API): AI speaking-feedback grading and part of writing-feedback grading.
  • Groq, Inc.: speech-to-text transcription of spoken responses (Whisper).
  • Resend, Inc.: transactional and reminder email delivery.
  • PostHog, Inc.: product analytics.
  • MongoDB, Inc. (Atlas): application database hosting.
  • Vercel Inc.: application hosting, content delivery, and file storage (Vercel Blob).

Your use of those services may also be subject to their own terms and privacy policies. We are not responsible for third-party systems we do not control. The data each provider processes is described in our Privacy Policy.

Suspension, termination & changes

We may suspend, limit, or terminate access to the Service if you breach these Terms, misuse the Service, create risk for other users, or if we need to address legal, operational, or security issues. On termination for breach, your account, study history, and your plan access may be revoked without refund.

We may also modify or discontinue all or part of the Service at any time. Where reasonably possible, we will give advance notice of material changes through in-product messaging, email, or the relevant legal page.

Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

We do not guarantee exam results, immigration outcomes, score-equivalency accuracy, AI-grading accuracy, or uninterrupted access. Practice scores, CEFR mappings, AI feedback, analytics, and recommendations are informational tools only.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, BUSINESS, GOODWILL, USE, DATA, OR EXAM OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IF WE ARE FOUND LIABLE DESPITE THE PREVIOUS PARAGRAPH, OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) CAD $50.

The above limitations do not apply to liability for fraud, gross negligence, or wilful misconduct, or to any other liability that cannot be limited under applicable law. Quebec residents have the rights set out under articles 1474 and 1475 of the Civil Code of Québec, which prevail to the extent of any conflict.

Indemnification

You agree to indemnify, defend, and hold harmless DELFPrep Inc. and our officers, directors, employees, contractors, agents, licensors, and successors from and against any claim, demand, loss, liability, damage, fine, penalty, cost, or expense (including reasonable legal fees) arising out of or related to (a) Your Content, (b) your breach of these Terms or any applicable law, (c) your misuse of the Service, or (d) your violation of any third-party right. This section does not apply to claims caused by our gross negligence or wilful misconduct.

Dispute resolution; arbitration; class-action waiver

Read this section carefully. It affects your legal rights and provides for the resolution of most disputes between you and us through individual arbitration rather than court proceedings or class actions.

(a) Informal resolution. Before filing any claim, you and we agree to attempt to resolve the dispute informally for at least sixty (60) days after written notice of the dispute is delivered to support@delfprep.com.

(b) Binding arbitration. Except as set out in subsection (e) and subject to applicable law, any dispute arising out of or relating to these Terms, the Privacy Policy, the Refund Policy, the Service, or the relationship between you and us will be resolved by final and binding arbitration administered by the ADR Institute of Canada, Inc. under its Arbitration Rules then in force, before a single arbitrator. The seat of arbitration is Toronto, Ontario, and the arbitration will be conducted in English unless the parties agree otherwise.

(c) Class-action waiver.You and we agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding.

(d) Quebec residents. If you are resident in Quebec when the dispute arises, the arbitration agreement in subsection (b) and the class-action waiver in subsection (c) do not apply to you to the extent they are prohibited under Quebec consumer-protection law, including article 11.1 of the Consumer Protection Act (RLRQ c. P-40.1). Quebec residents may bring claims in the courts of the Province of Quebec.

(e) Carve-outs. Either party may bring an individual action in a court of competent jurisdiction for (i) injunctive or equitable relief to protect intellectual-property rights, confidentiality, or security, and (ii) claims within the monetary limits of a small-claims court. Nothing in this section limits any right you may have to file a complaint with a regulator, ombudsman, or consumer-protection authority.

(f) Severability. If any portion of this section is held unenforceable, that portion will be severed and the rest will continue to apply, except that if the class-action waiver in subsection (c) is held unenforceable as to a particular claim, that claim, and only that claim, will proceed in court rather than in arbitration.

Governing law & jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in that province, without regard to conflict-of-laws principles. Subject to the dispute-resolution section above, the courts of Ontario have exclusive jurisdiction, and you and we attorn to that jurisdiction. This choice of governing law does not deprive you of the protection of mandatory rules of the law of the country or province in which you have your habitual residence.

General

Entire agreement. These Terms, together with the Privacy Policy, the Refund Policy, the Cookie Policy, and any checkout disclosures, are the entire agreement between you and us regarding the Service and supersede any prior agreements about the Service.

Severability. If any provision is held invalid, illegal, or unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full force.

No waiver. Our failure to enforce any right or provision is not a waiver of it.

Assignment. You may not assign these Terms without our prior written consent. We may assign them without restriction, including in connection with a merger, acquisition, sale of assets, reorganization, or bankruptcy.

Force majeure. We will not be liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, epidemics, war, civil unrest, sanctions, network or power failures, denial-of-service attacks, sub-processor outages, or failures of the public internet.

Survival. The sections on Your Content (for content already submitted), Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, Governing Law, and this General section survive termination of these Terms or your account.

Changes & contact

We may update these Terms from time to time. When we do, we will post the updated version on this page and revise the "Last updated" date and version. For material changes, we will give reasonable advance notice through in-product messaging or email. Your continued use of the Service after the updated version becomes effective means you accept the revised Terms.
